Teringat satu buku tulisan bekas FBI, John Douglas ke namanya kalau tak silap -
nama buku tu "Mindhunters"
Beliau menceritakan semasa pembikinan 'Silence of the Lambs', para pelakon dihantar ke HQ FBI utk membiasakan diri dgn cara2 operasi diaorg. Sekali tu, ada sorg pelakon lelaki (sorry tak ingat nama)Scott Glenn

Scott Glenn memainkan watak Jack Crawford yang berasaskan diri John Douglas bgtau kat John ni dia memula memang anti-hukuman mati. Tapi lepas melihat gambar2 drpd fail jenayah FBI esp. gambar mangsa wanita & kanak2, dia terus berubah jd penyokong kuat hukuman mati di US.

    Tak semua orang boleh dapat parol/plea bargain.. Kalau kesalahan teruk ya amat mesti kena penjara sepanjang hayat tanpa parole.

tak setuju.nanti jadi cam indonesia kes bunuh penjara 15-20 taun je.berlambak2 kes pembunuhan nanti.dah la skang ni ramai yang akal letak kat bontot.bahaya wooo.

Bukti2 dalam kes2 death row kat US banyak yang tak kukuh . Pakar2 saintis pun ada yang memberi fakta palsu , pemberi maklumat pun banyak yang bagi maklumat palsu .

Facts on Post-Conviction DNA Exonerations

There have been 289 post-conviction DNA exonerations in the United States.

• The first DNA exoneration took place in 1989. Exonerations have been won in 35 states; since 2000, there have been 222 exonerations.

• 17 of the 289 people exonerated through DNA served time on death row.

• The average length of time served by exonerees is 13.5 years. The total number of years served is approximately 3,800.

• The average age of exonerees at the time of their wrongful convictions was 27.

Races of the 289 exonerees:
180 African Americans
82 Caucasians
21 Latinos
2 Asian American
4 whose race is unknown

• The true suspects and/or perpetrators have been identified in 139 of the DNA exoneration cases.

• Since 1989, there have been tens of thousands of cases where prime suspects were identified and pursued—until DNA testing (prior to conviction) proved that they were wrongly accused.

• In more than 25 percent of cases in a National Institute of Justice study, suspects were excluded once DNA testing was conducted during the criminal investigation (the study, conducted in 1995, included 10,060 cases where testing was performed by FBI labs).

• About half of the people exonerated through DNA testing have been financially compensated. 27 states, the federal government, and the District of Columbia have passed laws to compensate people who were wrongfully incarcerated. Awards under these statutes vary from state to state.

• 22 percent of cases closed by the Innocence Project since 2004 were closed because of lost or missing evidence.

• About 80 percent of wrongful conviction cases overturned through DNA testing were single perpetrator crimes. Nearly 75 percent of the single perpetrator crimes involved eyewitness misidentifications, and about 75 percent of them were non-homicide cases. In about half of the single perpetrator cases, the real perpetrator has been identified.

Leading Causes of Wrongful Convictions
These DNA exoneration cases have provided irrefutable proof that wrongful convictions are not isolated or rare events, but arise from systemic defects that can be precisely identified and addressed. For more than 15 years, the Innocence Project has worked to pinpoint these trends.

Eyewitness Misidentification Testimony was a factor in nearly 75 percent of post-conviction DNA exoneration cases in the U.S., making it the leading cause of these wrongful convictions. At least 40 percent of these eyewitness identifications involved a cross racial identification (race data is currently only available on the victim, not for non-victim eyewitnesses). Studies have shown that people are less able to recognize faces of a different race than their own.These suggested reforms are embraced by leading criminal justice organizations and have been adopted in the states of New Jersey and North Carolina, large cities like Minneapolis and Seattle, and many smaller jurisdictions. Unvalidated or Improper Forensic Science played a role in approximately 50 percent of wrongful convictions later overturned by DNA testing. While DNA testing was developed through extensive scientific research at top academic centers, many other forensic techniques – such as hair microscopy, bite mark comparisons, firearm tool mark analysis and shoe print comparisons – have never been subjected to rigorous scientific evaluation. Meanwhile, forensics techniques that have been properly validated – such as serology, commonly known as blood typing – are sometimes improperly conducted or inaccurately conveyed in trial testimony. In other wrongful conviction cases, forensic scientists have engaged in misconduct. Read more.

False confessions and incriminating statements lead to wrongful convictions in approximately 25 percent of cases. In 35 percent of false confession or admission cases, the defendant was 18years old or younger and/or developmentally disabled. Twenty-two of the first 265 DNA exonerees pled guilty to crimes they did not commit. The Innocence Project encourages police departments to electronically record all custodial interrogations in their entirety in order to prevent coercion and to provide an accurate record of the proceedings. More than 500 jurisdictions have voluntarily adopted policies to record interrogations. State supreme courts have taken action in Alaska, Massachusetts, Minnesota, New Hampshire, New Jersey, and Wisconsin. Illinois, Maine, New Mexico, and the District of Columbia require the taping of interrogations in homicide cases. Read more.

Informants contributed to wrongful convictions in 19 percent of cases. Whenever informant testimony is used, the Innocence Project recommends that the judge instruct the jury that most informant testimony is unreliable as it may be offered in return for deals, special treatment, or the dropping of charges. Prosecutors should also reveal any incentive the informant might receive, and all communication between prosecutors and informants should be recorded. Read more.

The New Sunday Times (03/12/2006) blared out with its headline – “Lawyer in cahoots with Ah Long”.

This is in connection with the death of three young boys who were poisoned by their parents because of the pressure mounted on them by ruthless loan sharks. A very sad story to read. And it is something to worry about.

The word “cahoots” is of American origin. It means in “partnership with” or in “league with”.

The NST story stated that a particular lawyer in KL was struck off the rolls last year. Allegedly, he was involved in drawing up agreements for Ah Longs to tie-down the borrowers. Apart from this, it is not uncommon also for the lawyer to hold in escrow documents of charge, transfer, caveat, removal of caveat and a statutory declaration.

A reading in between the lines seems to suggest that the lawyer prepares all these documents and uses them as security and to give the Ah Long the advantage of taking over the house or selling it in the event of non-payment. By doing all these, it gives the moneylending transaction a semblance of legality.

Howsoever done, this is improper.

Under the Moneylenders Act, 1951, there is no provision for the making of such agreement.

Ordinarily, a moneylending loan agreement is drawn up. This is then used together with the original title to create a moneylending charge.

If the NST allegation is true, it is a matter of grave concern to the Malaysian Bar.

Perhaps, the NST can give more details and help to stamp out such improper and fraudulent practice.

What the report is suggesting is that lawyers dishonestly draw up sale and purchase agreements as additional collateral to disguise the actual moneylending transactions.

This is highly questionable and is a clearcut breach of professional ethics.

The Perak Bar Committee views with deep concern such disguised transactions.

tak sokong hukuman mati dimansuhkan... kena kekalkan hukuman mati bagi kesalahan2 yg berat, yg mengancam warga dan negara... gantung ka, nak tembak ka, nak pancung ka, nak bagi kerusi karan, nak cucuk racun ka... terserah pada pihak berkuasa, tapi mesti kekalkan hukuman mati... dan tempoh pelaksanaan hukuman mati tu, biarlah cepat, jangan makan tahun, baru nak buat, paling2 lama, bagi can setahun sudah... macam singapore, maksimum 6 bulan... lepas tu selamat jalan!

    mmg le si pengedar dadah tu bukan membunuh secara fizikal mcm mana pembunuh bunuh sosilawati tuh
tapi pengedar dadah bunuh byk org secara senyap dan perlahan2.. dah tu dia kutip untung pulak atas kematian secara perlahan!
penagihan dadah ni plak akan menyebabkan sipenagih agresif.. dah byk kejadian si penagih bunuh mak, ayah, abang, atok , nenek, utk dptkan wang dan fikiran dah tak rasional

kalo tak digantung si pengedar dadah ni akan menyebabkan lambakan penjenayah di malaysia, rakyat jugak yg kena tanggung makan minum depa

oleh itu, sara sangat bersetuju pengedar dadah ini dihukum gantung sampai mati, harta bendanya di sita dan dijual lelong duitnya masuk dlm perbendaharaan negara!

p/s : peguam nih peguam bela pengedar2 dadah yg dimonopli oleh bangsa cina tu ke? :lol:
