Pehh! Cakap omputeh. Abang dizek ni penyokong tegar umno kan. Tapi apa pasal tak cakap Melayu? Malu ke? Ke dah takde jati diri? Ke join umno sebab nak duit je?

Sebagai makluman, dalam bahasa inggeris, selepas perkataan 'to' kena pakai present tense. jadi 'to tarnished' tu salah. Yang betul 'to tarnish'

Jose Ugaz

José Carlos Ugaz Sánchez-Moreno (born June 15, 1959) is a Peruvian jurist. He served as Ad-Hoc Attorney of Peru for the highest profile criminal cases in recent Peruvian history, involving the investigation of former President Fujimori and his chief of intelligence, Vladimiro Montesinos.

José Ugaz studied Law at the Pontifical Catholic University of Peru. After graduating from Law school in 1984, with Postgraduate education in Human Rights and Development (Institute of Social Studies, The Hague, Netherlands) and Criminal law (University of Salamanca, Spain), he joined the Lima Bar Association and became partner of Bettocchi Ibarra-Ugaz Law firm. In 1993 he founded Benites, Mercado & Ugaz Law firm (now Benites, Forno & Ugaz).

He was retained as external consultant to Dutch organizations Hivos and Novib for Human rights assessment missions in Costa Rica and Sri Lanka (1990–1991). In 1992, he joined the UN Peacekeeping Mission for El Salvador (ONUSAL) as Human Rights Official, and in 1993 was member of the UN Election Observers Mission for El Salvador.

Professor of Criminal law at the Law School of the Pontifical Catholic University of Peru (1987–2011), José Ugaz was member of the Board of the Law School for the period 1995-2001 and re-elected for the period 2008-2014.

José Ugaz was appointed as Ad-Hoc State Attorney of the Republic of Peru in several corruption cases: Zanatti (1993-1994);[1] CLAE (1994),[2] INABIF (1997),[3] Montesinos[4]-Fujimori[5] (2000-2002); in this particular case, he organized an office with 3 deputy State Attorneys, a Financial Intelligence Unit and a team of 25 people. During Ugaz administration, more than 200 judicial cases were opened against more than 1,500 members of the Fujimori’s network, Montesinos was captured in Venezuela in coordination with the FBI,[6] as well as other 120 members of the organization including the former Attorney General, President of Congress, Supreme Court Justices, Electoral Magistrates, Broadcasters and 14 Generals of the Armed Forces and Police. During his mandate, US$205 million were frozen abroad and US$150 million were recovered from USA, Switzerland, Grand Cayman and Peru.[7]

In 2002 was invited to assume the presidency of PROETICA, the Peruvian chapter of Transparency International. In 2004 he was elected as Peruvian Eisenhower Fellow for the Multi-National Program (United States, March–May) and later that year, joined the Institutional Integrity Office of the World Bank (2004-2006).

Member of the group of experts for the "Second Session of the Ad Hoc Committee of the Negotiation of a United Nations Convention against Corruption” (2002). Since 2008, he is member of the International Anti-Corruption Conference (IACC) Council, and Individual Member of Transparency International. Representative of Transparency International at the expert meeting of the MESICIC (follow Mechanism of the Inter-American Convention Against Corruption, Washington DC, March 22, 2010). Expert member of the working group that prepared the "Asset Recovery Handbook: A Guide for Practitioners" (World Bank/UN, Viena 2009, Marsella 2010).[8]

José Ugaz is speaker in different events and countries on Corruption and Money Laundering: APEC, OECD, USA, Argentina, Ecuador, Colombia, Paraguay, Bolivia, Nicaragua, Honduras, Panamá, UK, Check Republic, México, Switzerland, Spain, Brazil, Chile, Guatemala, Japan, Korea, Greece and Thailand.

He was elected as member of the Transparency International Board for the period 2011-2014.


Najib Razak

Dato' Sri Haji Mohammad Najib bin Tun Haji Abdul Razak (born 23 July 1953) is the sixth and current Prime Minister of Malaysia. He was sworn in to the position on 3 April 2009 to succeed Abdullah Ahmad Badawi. He is the President of the United Malays National Organisation, the leading party in Malaysia's ruling Barisan Nasional coalition.

Najib is the eldest son of Abdul Razak Hussein, Malaysia's second Prime Minister, and the nephew of Hussein Onn, Malaysia's third. He was elected to the Parliament of Malaysia in 1976, at the age of 23, replacing his deceased father in the Pahang-based seat of Pekan. From 1982 to 1986 he was the Menteri Besar (Chief Minister) of Pahang, before entering the federal Cabinet of Mahathir Mohamad in 1986 as the Minister of Culture, Youth and Sports. He served in various Cabinet posts throughout the remainder of the 1980s and 1990s, including as Minister for Defence and Minister for Education. He became Deputy Prime Minister on 7 January 2004, serving under Prime Minister Abdullah Ahmad Badawi, before replacing Badawi a year after Barisan Nasional suffered heavy losses in the 2008 election.

Najib's tenure as Prime Minister has been marked by economic liberalisation measures, such as cuts to government subsidies, loosening of restrictions on foreign investment, and reductions in preferential measures for ethnic Malays in business. His Barisan Nasional coalition was re-elected at the 2013 election, albeit with a reduced majority due in large part to a substantial movement of urban voters to opposition parties. After the election his government was marked by the pursuit of a number of its critics on sedition charges, the imprisonment of opposition leader Anwar Ibrahim following a conviction for sodomy, the implementation of a Goods and Services Tax, and an ongoing scandal involving state investment firm 1Malaysia Development Berhad which led to rallies calling for Najib's resignation, spearheaded by the grassroots movement Bersih.[1][2][3]

Najib's various subsidy cuts have contributed to soaring living costs,[4] while fluctuating oil prices as well as fallout from the 1MDB scandal have led to a steady depreciation of the Malaysian ringgit.

Minister Paul Low, if you have just sat quietly with your head buried under the sand, I think many would have perfectly understood and tolerated you. After all, we have not expected much from you. You were not even elected and no one for sure knew what you stood for except from during your short tenure in Transparency International- Malaysia.

Your problems start when you start talking. When you try to defend the indefensible, explain the unexplainable, justify the unjustifiable, and rationalise the most bizarre, that is when many are annoyed.

No one is asking you to be a ‘loose cannon’, much less to make accusations without evidence or proof. So it is not necessary for you to defend yourself in that regard. But as the minister in charge of integrity, we expect you to protect the honour and robustness of any investigation. Have you been able to do that?

Can you show us evidence that you have diligently, dutifully and fearlessly defended the investigation process regardless of the target of investigation? Please, we want an honest answer from you, no more and no less.

You said at the 16th International Anti-Corruption Conference (IACC) that you have to wait for investigation to be completed before disclosing details to the public. This is just too convenient a ‘tai-chi’ tactic. First, how sure are you that the investigation is still on-going? Second, what is the time frame of that investigation, if not already derailed? And third, if ever the investigation is completed, will it be made public?

Many of us have every reason to be pessimistic; after all, as the minister, have you read the auditor-general’s interim report on 1MDB that was completed in June, 2015? When will the report be made public?

You are on record to have said that too much openness is akin to pornography. I do not want to accuse you for being distasteful because that is your choice of words and analogy. But you have to define for us the meaning of openness. If I’m mistaken, are you implying that our transparency standard is already too high and therefore any further improvement would make us completely naked? I think you are probably confusing inputs with outputs.

You must be thinking that if Malaysia has an anti-corruption commission, our integrity standard must be higher than say Singapore which only has a bureau. If Malaysian has a minister in charge of integrity, our governance standard must be higher than other countries which have none.

If Malaysia has numerous advisory panels formed to watch over the Malaysian Anti-Corruption Commission (MACC), our fight against corruption must be more robust and stringent than others. And don’t forget, if Malaysia presents its audit reports three or four times a year, our transparency standard must be higher than other countries which present their reports only once a year.

I am sure you have heard of the saying - the proof of the pudding is in the eating. It is useless to claim we have done great things when unexplained 1MDB debts, political ‘donation’, the wheeling and dealing of government lands, personal bank accounts, and Cayman Islands are tanking the country right now.

A separate service

Now you want to make MACC a separate service out of the purview of the civil service and the tenure of its chief commissioner more secure. You also want the auditor-general to report to a bi-partisan special committee in Parliament. All these proposals seem reasonable but they may be too simplistic and too late in the day.

As you may be aware, the civil service, too, has a Public Services Commission which is supposed to safeguard civil service neutrality and independence. But do we have a civil service that is neutral and independent today?

On the security of tenure of the MACC chief commissioner, I suggest we look at judges, the auditor-general and the attorney general. Right now, they enjoy security of tenure under our constitution but do all of them behave independently, professionally and without blemish?

I hope you have considered holistically how a separate service commission for MACC and how a secured tenure for its chief commissioner would make a significant difference to our fight against corruption? Sometimes we think there are simple solutions to complex problems. Usually they don’t.
