Bekas Koperal Polis Terlepas Hukuman Gantung, Diganti Penjara 10 Tahun

Mahkamah Rayuan menggantikan hukuman mati terhadap bekas koperal polis kerana membunuh anak tirinya, Hanis Amanda Mohd Zafil yang berusia dua tahun pada 2015, kepada penjara 10 tahun.
Oleh itu, Muhammad Khairuanuar Baharuddin, 42, terlepas hukuman gantung bagi kesalahan menyebabkan kematian tanpa niat.
Panel hakim yang terdiri daripada Datuk Seri Kamaludin Md Said, Datuk Hashim Hamzah dan Datuk Azman Abdullah menjatuhkan hukuman itu terhadap Muhammad Khairuanuar yang merayu terhadap sabitan dan hukuman mati.
Dalam alasan penghakiman yang dikeluarkan pada 6 Jun, Azman berkata, selepas meneliti keterangan, mahkamah mendapati Mahkamah Tinggi tersilap dalam mensabitkan Muhammad Khairuanuar atas kesalahan membunuh kerana pihak pendakwaan gagal membuktikan bahawa dia mempunyai niat untuk mendatangkan kecederaan pada badan kanak-kanak itu yang menyebabkan kematiannya.
Beliau berkata, mahkamah berpendapat keterangan daripada pihak pendakwaan kurang dalam membuktikan bahawa Muhammad Khairuanuar mempunyai pengetahuan bahawa perbuatannya itu amat berbahaya sehingga kemungkinan besar boleh menyebabkan kematian, atau kecederaan badan itu berkemungkinan menyebabkan kematian.
Hakim itu berkata, berdasarkan keterangan seorang saksi pendakwaan yang tinggal di kondominium tersebut bahawa dia mendengar kanak-kanak itu menjerit kira-kira 3 petang dan masih hidup pada 5.20 petang.
Saksi itu turut melihat kanak-kanak berkenaan terbaring sambil memegang botol susu di hadapan televisyen selepas itu.
Muhammad Khairuanuar didakwa membunuh Hanis Amanda di sebuah rumah di kondominium di Seksyen 5, Wangsa Maju, Kuala Lumpur antara 7 pagi dan 7.30 malam pada 6 Nov 2015.
Dia didapati bersalah terhadap pertuduhan itu dan dijatuhi hukuman mati oleh Mahkamah Tinggi Kuala Lumpur pada Mac 2021. Dia kemudiannya merayu ke Mahkamah Rayuan.
Bapa kandung kanak-kanak itu dan ibu tirinya memberi keterangan bahawa mereka menyedari terdapat kesan lebam pada badan kanak-kanak itu terutamanya pada bahagian rusuk dan pehanya semasa berada dalam jagaan mereka antara 17 Okt 2015 dan 19 Okt 2015.
Bapa Hanis Amanda juga memberi keterangan di mahkamah bahawa anaknya sakit dan memberitahu " apa Bi" yang menyebabkan lebam itu. Menurutnya "apa Bi" yang disebut oleh anaknya itu merujuk kepada Muhammad Khairuanuar.
Ibu bapa kanak-kanak itu bercerai pada 2013 dan ibunya berkahwin dengan Muhammad Khairuanuar, manakala bapanya berkahwin dengan wanita lain.
