pindah milik rumah

aku ade persoalan

bapa aku dah xde (meninggal)
dia ade tinggal kn umah (nama bapak)
tp loan nama kakak aku

aritu buat surat kuasa.
akak aku xmo tuntut rumah tu
nak bagi adik aku

cadang nya loan tu nak abis kan byr nye
then nak tukar name adik aku

camne ek?
kena guna lawyer x?

kos lak RM brp?

setahu aku kalau kes2 melibatkan pindahmilik,harta memang kena guna peguam, kos tak sure, boleh je pegi tanya dulu berapa kos

loan kena abis byr dulu baru bole tukar nama. harta yg masih ada hutang x bole tukar nama lagi.

lps rmh tu settle hutang, kalau arwah bapa xde pernah buat wasiat, pegi pejabat tanah bahagian pesaka kecil utk mohon surat kuasa. nnt mahkamah panggil ahli keluarga angkat sumpah pastu keluarkan surat kuasa mentadbir. pastu nnt kena senaraikan harta atas nama arwah bapa yg official. pastu nnt baru boleh keluar sijil faraid. (yg ni step by step pun mkn masa)

setahu aku prosesnya agak rumit & tidious. sebab tu org upah lawyer utk uruskan. ko cari la lawyer yg berpengalaman. lawyer yg buat convencing.

mmg adik bradik dah stuju nak namekn adik aku rumah tu
dah gi mahkamah pon
cuma surat dr mahkamah lom dpt lg

loan akak aku nak abiskn bayar n tuka ke nama adik aku nama rumah tu

konpem kena guna lawyer sebab melibatkan hak milik hartanah...
cari property solicitors..
banyak jek opis deols nih especially dekat bangunan2 kerajaan cam epf, lhdn...
bab kos tu pulak, dia akan calculate semua kos la campur fotostat duit minyak duit setem segala bagai...
lagi simple kes uols lagi kurang kos..
kalau kena deal banyak pihak so banyakla kos..
ada beli rumah bebaru ni total lawyer fees dekat rm3k from a to z la lawyer tu handle..

belum la. kena tunggu sijil faraid yg menunjukkan rumah tu nanti bagi ke adik awak baru bole pindah nama. cuma x pasti sijil faraid sape yg keluarkan.

cuma aku confius, yg mahkamah nk keluarkan tu surat apa? surat tadbir & surat kuasa tu berlainan ke?

kt pejabat tanah ada bahagian pesaka kecil. kt situ pun bole buat urusan pembahagian harta ni. mungkin surat kuasa mentadbir kot. nnt kt situ ada bahagian dibagi kuasa utk memindah. pindah dari nama arwah bapa kpd nama adik awak.

tp kuasa menjual xde rasanya. yg tu kena mohon lain.

Assalamualaikum,

Melalui pengalaman saya, peruntah yg dikeluarkan oleh pejabat pesaka kecil adalah perintah pembahagian. Bila keluar sahaja perintah tu, dah boleh bawa bersama dgn geran ke pejabat tanah untuk tukar nama.

Bila dah tukar nama, owner baru berhak buat apa shj menurut undang undang malaysia.

Kalau geran berada di bank, maknanya loan belum habis bayar. Kalau ada mrta, apabila owner geran atau borrower meninggal dunia mrta akan cover sedikit atau sepenuhnya. Better check
