What are the rights of tenants?

What should tenants do?

I am bit worry about things like this would occur... What should I know before say yes?



To all freshies who came far away to KL to study, you might want to concentrate on your studies and enjoying the life here. However, you might fall into the traps set by landlords and got into endless troubles if you're not careful.

I was a recent victim who rented a room in one of the double storey house in Section 17, by a landlord known as Mr. Lee. I and my boyfriend each took a room separately, which cost RM350 each.

When we went to see the rooms, the landlord promised to sign a rental contract with us, as well as providing a space for my boyfriend to park his car. When we paid him the rental and deposit and starting to move things in, he refused to sign the contract. We were stuck in the middle so are forced to give in.

The landlord has agreed that the RM350 included the water and electricity bill. But the stupid fellow provided air conditioner to the people living in the master room. When he saw the raise in the bill, he forced me and my boyfriend to pay him an extra RM20 each, although we don't have air conditioner in our room.

The landlord promised not to enter our rooms without permission when we were discussing the conditions before moving in. But then we found out that he intruded our rooms when we went out. When my boyfriend confronted him, he yelled at him and said that this is his house.

He also refused to fix the water filter and the broken pipe inside the toilet, although being informed for a few times.

As for the parking space, first he promised that it's my boyfriend's parking space. But then he let another girl in the house to park on that space, and he parked his own car in the girl's original space.

On 31st December 2005, the whole street was being fully occupied by other cars, due to heavy rain, my boyfriend parked his car in front of the gate, blocking half of the landlord's gate (he lives next door) to avoid big water puddle. Then the landlord suddenly got back, and screamed and banged on our doors because he got wet in the rain. He blamed my boyfriend for blocking the gate and made him got wet. So on 1st January, he sent sms to us and asked us to leave his house before 4th January. He didn't even give us a 1 month notice! He also treaten to throw our things out if we don't move out in time.

Be very careful when you rent rooms. Sometimes, living next to the landlord's house only means inviting troubles for yourself. Some landlords may act very friendly because they are desperate in renting out their house or rooms, so talk to him more and observe carefully. And, always asks to sign a contract, because there are many mean landlords exploiting students nowadays. With a contract, at least you're more protected than having nothing.

rigts of the tenants? you have to draft a good tenancy agreement and your right reserve on that agreement... do not afraid to engage a lawyer...bro

I know... but can we as non-authority party write a legal contract that could be legal in court?

now is this doubt or problem....

I will rent a room via a tenant but not owner. the tenant rent the whole house and rent a room for me.

what makes me doubt is that even is the contract is sign, it is between me and the tenants.

and the owner are not acknowledge about a thing, if anything goes wrong and the tenant run will I get my deposite back?

as I paid the tenant not owner

so? :stp:  

am I worry too much?

the tanant are allow to make a sub rent provided that the owner give the first tenant rigt in their Tenancy Agreement.

it doesnt make a contract invalid just because it was not prepare by the lawyer...
any body can draft and enter a valid contract provided that its follow contract prinsiple...

but if u want to play save better do it thru a legal prac..

Oooo.......

So the person that rent the whole apartment from the Landlord is First Tenant? as it put it as Premise Representative.

this is what I write by editing from previous agreement. What say you? where goes wrong?

What else should I include?

the names and address are changed but others remain the same

That a good simple example of a draft tenancy agreement.

U see, it does not take a lawyer to make a contract agreement, even a laymen can do it provided they follow the principal elements of contract drafting.

After u made that agreement and signed by both parties in front of Pesuruhjaya Sumpah (Commissioner For Oaths), go to the nearest LHDN branch (Jalan Duta or Jalan Kg Attap) to set a Stamp Duty and viola!! you got yourself a legally binding contract!
