Mawi fails to strike out RM1m copyright infringment suit

KUALA LUMPUR, Thurs:
Entertainer Mawi has failed in his bid to strike out a RM1 million copyright infringement suit that was filed against his company. The decision was made by the High Court senior assistant registrar Norashikin Sahat today.
Norashikin also ordered Mawi World Sdn Bhd to pay costs. Mawi World was represented by counsel Juliana Mohamad, while the suing company Yassa Sdn Bhd, was represented by counsel Adnan Seman @ Abdullah.
With the decision, the matter will be put on trial but a date had yet to be fixed. It is learnt Mawi World may file an appeal over Norashikin抯 decision. Yassa filed the suit on Oct 30, 2006, alleging that Mawi World had infringed on its copyright.
Yassa, which is based in Rembau, Negeri Sembilan, alleged that one of its directors went to a supermarket in Subang Jaya on Sept 30, 2006, and found Mawi World mineral bottles on a shelf. The bottles bear the same license number and nutritional contents as the mineral water produced by Yassa.
Following the discovery, a Yassa representative lodged a report at the Seremban police station on Oct 2, 2006, the same day Mawi launched the mineral water. It is seeking RM1 million in general damages, exemplary damages, costs and an injunction barring Mawi World from continuing to violate its intellectual property.
Mawi World, in its striking out application claimed that the suit did not reveal any reasonable cause of action that could be taken against it.
The entertainer whose real name is Asmawi Ani, 27, in his supporting affidavit claimed that the suit was frivolous, vexatious and an abuse of the court process. |
