High Court corrects magistrate court's order for exhumation of Cradle CEO

SHAH ALAM (Bernama): The High Court here on Thursday (Oct 4) corrected an order issued by the Petaling Jaya magistrate's court on Monday (Oct 1) which allowed police to exhume the body of Cradle Fund Sdn Bhd chief executive officer Nazrin Hassan.
Judge Datuk Ab Karim Ab Rahman used his discretion to correct the provision under Section 339(3) of the Criminal Procedure Code (KPJ) to Section 329 (3) of the same Code.
"The magistrate should not have issued the order under Section 339(3) of the KPJ because the section involved the application for inquest, while the case is still at investigation stage.
"In this regard, I corrected the magistrate's order under Section 329(3) of the same code to empower police exhume Nazrin's grave to determine the cause of his death," he said.
The application to exhume Nazrin's grave was to enable a second post-mortem to be conducted on him.
Selangor CID chief SAC Fadzil Ahmat in a statement earlier said the second post-mortem on Nazrin was conducted as some family members were not satisfied with the earlier report.
At the same proceeding, Judge Ab Karim sets additional conditions which was agreed by the prosecution for a family member (victim's wife) and a religious representative to be present during the digging of the grave and reburying.
"The applicant (victim's wife) as the next of kin is allowed to be present during the process of the second post-mortem as well as an independent pathologist if it was approved by the pathologist conducting the second post-mortem," he said.
Earlier, in his argument, counsel Hisyam Teh Poh Teik said the order issued by the magistrate's court was not in accordance to the law as the section used by the magistrate was for the application of inquest while application by police was to exhume Nazrin's grave for a second post-mortem on the body.
Deputy public prosecutor Datuk Jamil Aripin said the application review by the counsel was baseless and premature as the case was still under investigation.
"There are no illegality and impropriety on the order of the magistrate's court. Nobody should stop the police in carrying out their investigation," he said.
On Sept 4, Nazrin's wife and her former husband were remanded for seven days to assist investigations into the case.
On Sept 9 two teenagers aged 14 and 16 were also remanded.
On Sept 24, a couple including Nazrin's sister-in-law were remanded for four days, and were released after the remand expired.
Nazrin died in a fire in his house at Mutiara Homes in Petaling Jaya at about 12.20pm on June 14.
His death was later reclassified as murder under Section 302 of the Penal Code after the Fire and Rescue Department found the presence of petrol at the fire location. – Bernama

umpama sorang bohjan ditahan kerana disyaki merosakkan anak dara orang... keluarga pmpn tu nak buat check up di hospital tengok dah lobos ke tak atau kesan cecair tertinggal dan polis benarkan... tapi bohjan tu bantah jadi mahkamah kata tak boleh...
atau kes anwar dulu... katalah setelah saipul bukari kena sontot dia kena check dgn hospital... anwar sebagai suspek kata tak boleh.. maka mahkamah ikut cakap anwar... nasib baik si saipul tu tahan berak 3 hari je.. kalau undang2 miki maus harus setaun tak berak si saipul tu sebab mahkamah ikut cakap anwar yg juga seorang suspek...
ataupun kes pemes yg digemari maideen bila seorang lobai pendera menala bini masa ada bisul di montotnya... perlu medical check up tapi si lobai a.k.a si laki a.k.a suspek cakap tak boleh.. jadi mahkamah diam membisu ikut cakap suspek...
tu tubuh badan orang dah mati... apa yang takut sangat? kalau hidup mungkin la nak tutup aib tapi dah mati dan bukannya secara terbuka.... apa punya turrrr.... mikimaus...
akak kalau terserempak si tanggechi ni atau ahlil keluarga dia terutamanya budak dua ekor tu di taman tun atau uptown mmg akak ludah depan2 tak pun kensel order makan tempat lain... wilcha tak wilcha akak hamput je...

Untuk Malaysia, kita tak pakai istilah manslaughter. Kesalahan yang corresponding kpd manslaughter ialah culpable homicide not amounting to murder dalam Kanun Keseksaan atau Penal Code. Seksyen hukuman yg mungkin biasa orang ramai dgr utk kesalahan ini ialah seksyen 304. Kalau murder, seksyen hukumannya ialah 302. |

So akan exhume ke tak? News ni macam ckp harituu magistrate yg benarkan untuk exhume guna seksyen yg salah, was made under the wrong legal provision seksyen 339(3)... so this judge review the previous order and betulkan under the correct provision which is seksyen 329 ... tapi still dibenarkan untuk exhume kann? Bukannya cancel |

Court allows Cradle Fund CEO’s post-mortem to proceed on Monday
SHAH ALAM: The High Court today dismissed a bid by Samirah Muzaffar, the wife of Cradle Fund CEO Nazrin Hassan, to challenge a lower court’s order to exhume his body for a second post-mortem next week.
Lawyer for the widow, Hisyam Teh, said Justice Ab Karim Ab Rahman ruled in favour of the police and that the post-mortem will proceed next Monday.
“But the court also gave an order for her and a religious scholar to be present at the post-mortem process.
“She can also bring her choice of pathologist, subject to the government pathologist’s consent,” he said.
Teh said, initially, the widow sought to quash the Magistrate’s Court order on Monday that allowed police to exhume Nazrin’s remains from his grave for a second post-mortem.
The widow claimed the order by the magistrate, Nor Ariffin Hisham, was “bad in law” as he had applied the wrong provision under the Criminal Procedure Code (CPC).
Teh added the judge did not agree with their argument but corrected the magistrate’s order to Section 329 from Section 339(3) of the CPC.
Section 329 touches on the duty of police to investigate death while Section 339(3) refers to inquest proceedings.
Selangor Criminal Investigation Department chief Fadzil Ahmat said his officers applied for an order to exhume Nazrin’s remains, after Nazrin’s brother lodged a police report last week.
He said the late CEO’s family was not satisfied with the Hospital Kuala Lumpur’s pathologist report.

Dia puas hati kot it was a blast injury. Yg buat initial post mortem pun ada byk pengalaman.
Kalau betul then mesti reveal la jenis phone dgn result analisis sebab melibatkan keselamatan orang ramai.
Kalau blast sampai berlubang mesti ada pieces lodged in the brain. They should be able to tell if the shrapnels came from a phone.
