In China, a Good Samaritan is hard to find

If you are injured or happen to fall down in the street, in China you may be left to fend for yourself.
(Ecns.cn) –If you are injured or happen to fall down in the street, in China you may be left to fend for yourself. A series of cases involving people getting sued after helping strangers has led many people to become wary of lending a hand to their fellow man – or, as is often the case, to an elderly woman.

Just last Sunday, an 88-year-old man who had fallen down later died after being ignored by bystanders in Wuhan, Hubei Province. This year the number of similar cases has been increasing.

The "Farmer and the Snake" trick

In November of 2006, an elderly woman surnamed Xu in Nanjing, Jiangsu Province, suffered two fractures after falling at a bus station. She later successfully sued a man named Peng Yu, who claimed to have voluntarily helped her.

Despite a lack of evidence, a local court ruled that Peng was guilty and ordered him to pay compensation of over 40,000 yuan ($6,184) to the woman. The verdict was based on the "logical thinking" that it was highly possible that Peng had knocked the woman down, otherwise he would not have helped her to hospital. The case was eventually settled out of court with mediation from provincial officials.

Since then, the name "Peng Yu" has become a label for such cases, leading many to believe that helping out an old lady might not be the best idea.

In August 2009, another senior citizen named Wang Xiuzhi fell to the ground when she violated regulations by crossing the guardrail along a road in Tianjin. A driver named Xu Yunhe saw the whole scene and extended her a helping hand by sending her to the hospital. However, Xu was later brought to court by the lady, who claimed his car had hit her.

Although traffic police tested Xu's car and found no evidence that it had struck the woman, the court ordered Xu to pay her 100,000 yuan ($15,460) in compensation, saying there was a possibility that the lady had fallen for fear of being struck by his approaching car.

Many people accused Wang of twisting the facts and framing the man. When she emerged in a wheelchair from Tianjin No. 1 Intermediate People's Court one afternoon, Wang and her relatives came under siege from angry citizens. Xu appealed the ruling, insisting that he was innocent.

In another case, Yin Hongbin from Nantong, Jiangsu Province, was driving a coach when he saw an old lady lying on the ground near her damaged tricycle on August 26. He pulled over and came to the lady's assistance. When he was sure she wasn't badly hurt, he entrusted her to one of her fellow villagers, and the old lady expressed her gratitude.

To the driver's surprise and outrage, the old lady's son later telephoned the traffic police, claiming that a coach had struck his mother and the driver had fled the seen.

Yin was lucky that the video camera on his coach had recorded his actions, and that a passenger also verified his account. Though the old lady and her son thanked Yin after the police confirmed the facts, the incident stirred public outrage.

Heroes still exist

It is a sign of sick society when one must protect oneself before offering help to a stranger for fear of being framed. Yet good things are also happening.

Last July, a two-year-old girl who fell from her tenth-floor home in Hangzhou, capital of eastern China's Zhejiang Province, was miraculously saved by a young mother who happened to be walking by. The woman surnamed Wu managed to catch the girl before she hit the ground. However, Wu was not able to hold onto her because of the force of the impact. Both Wu and the girl were rushed to the hospital. From then on, as a true hero, Wu was named the "most beautiful mother in China."

Also in July, a 20-year-old girl named Yu Shuhua became an Internet star in China for giving her "first kiss" to a drowning elderly man. It was reported that she was on her way from work when she saw the man being rescued from a river. Having just graduated from a nursing college in Beijing, Yu cleared the man's airway, knelt down and immediately gave him mouth-to-mouth resuscitation and performed cardiac massage. After the news spread nationwide, many netizens saluted Yu and named her the "most beautiful girl in China."

Then there was also the "most beautiful grandmother" who gave her own life to save a drowning boy, after already having saved three children from a river.

According to Xia Xueluan, professor of sociology at Peking University, these titles indicate an eager demand for social morality. The public believes these "beautiful" people did the right thing out of instinct, which revealed their purity, goodness and beauty, he said.

Morals need to be strengthened

The real-life "Farmer and the Snake" stories have sparked a new round of debate over China's public trust, legal procedures and moral decline, especially since a majority of people say they would not offer assistance if they came across an old man who had fallen down, because they were afraid of being sued.

The negative impact of these cases on society can not be underestimated, and relevant departments must be cautious in handling such cases to avoid hurting the innocent. Meanwhile, China must strengthen its legal and social security systems. Only then can we all hope to be the "most beautiful."

kalau iye pun org2 yg lalu lalang tu takut kena bayar medical expenses budak tu or kena saman, takkan la takat tolong callkan ambulance pun tak boleh? ini memang mentaliti komunis.. sebab dah takde rasa belas kasihan..

hopefully perkara sedemikian tidak berlaku di Malaysia...

No wonder people mcm takut nak tolong org..

kat mesia nih, dulu2 kalau ada jumpa kreta rosak, pemandu2 yg lain willing berhenti nak tolong...tp sekarang nih tidak lagi..takut terkena dgn perompak yg berpura2...

mentaliti komunis palohotak ko... komunis ni dia amik tanah sume org, usahakan sama2...bahagi hasil sama rata. masyarakat di bwah kerajaan yg mengamalkan ekonomi komunis jarang melakukan jenayah kerana tiada pengangguran dan jurang kaya dan miskin yg hampir tiada. mereka bekerjasama sbg satu pasukan.

tp china amalkan sistem ekonomi kapitalis since three decades ago. so, ade org akan ambil kesempatan ke atas kesusahan org lain. dan isu ni pun berlaku kerana "Peng Yu incident". baca betul2..x de kena mengena dgn komunis...

ko kalau nak mengutuk biar yang sebetulnya..

contoh kutukan yang salah: Muslim Makan Babi!...salah sbb org islam x mkn babi.
