GABUNGAN Pilihan Raya Bersih dan Adil (Bersih 2.0) mendakwa sekiranya perintah darurat membabitkan penggantungan Parlimen dan kebebasan awam, ia adalah sama seperti rampasan kuasa.

Menerusi kenyataan yang dikeluarkan Jawatankuasa Pemandu Bersih 2.0, berkata langkah itu dilihat untuk memastikan kerajaan Tan Sri Muhyiddin Yassin untuk terus kekal berkuasa.

Perintah darurat membenarkan kerajaan lantikan Agong untuk membuat ordinan yang akan mempunyai kuasa dan kesan yang sama seperti akta oleh Parlimen dan ia akan berkuatkuasa sepenuhnya sehinggalah ianya ditarik balik atau dibatalkan serta ordinan tersebut tidak boleh dicabar di mahkamah.

Darurat juga akan memberikan Kerajaan Persekutuan kuasa untuk melanggar bidang kuasa kerajaan negeri.

Kali terakhir perintah darurat seluruh negara diisytiharkan pada tahun 1969 disebabkan oleh peristiwa 13 Mei ketika itu.

Selain kerumitan yang akan timbul terhadap semak dan imbang demokratik dalam negara kita, ekonomi negara juga akan turut terjejas dengan teruk, katanya.

Bersih 2.0 berkata, sekiranya tujuan darurat adalah untuk melawan Covid-19, Perintah Kawalan Pergerakan (PKP) yang bersasar seperti yang sedang dilaksanakan sekarang adalah mencukupi.

Akta 342 atau Akta Pencegahan dan Kawalan Penyakit Berjangkit 1988 mempunyai peruntukan yang mencukupi bagi menyediakan langkah-langkah pencegahan penyebaran Covid-19.

Ia termasuklah kuasa untuk membuat peraturan, kawalan pergerakan orang ramai dan menggerakkan pasukan bersenjata sebagaimana yang telah kita lihat sebelum ini,katanya.

Sementara itu, Bersih 2.0 memohon kepada semua ahli politik untuk mengenepikan sebarang perbezaan dan bekerjasama dengan persetujuan keyakinan dan perbekalan.

Ini bermaksud pembangkang akan bersetuju untuk tidak menentang kerajaan Perikatan Nasional dalam undi percaya atau berkenaan isu perbekalan namun masih mengekalkan hak untuk membangkang rang undang-undang yang lain.

Ini bagi memastikan bahawa bantuan belanjawan Covid-19 yang akan dibentangkan pada bulan hadapan akan diluluskan dan mengekalkan kestabilan dalam Parlimen, katanya. C Malaysiapost

IS MUHYIDDIN LAUNCHING A SELF-COUP IN ORDER TO STAY IN POWER?

The Coalition for Clean and Fair Elections (BERSIH 2.0) is alarmed that rumours are rife that a State of Emergency will be declared with several news portals and mainstream media quoting unnamed sources that this was decided in a special cabinet meeting today. The Star reported that the move is to step up the fight against the COVID-19 pandemic that has spiked sharply over the past one week, as well as to put a stop to political squabbles. If the aim is to deal with the COVID-19 situation, such a move is overkill, unnecessary and sets a dangerous precedent for democracy in this country.

In view of the fact that the Perikatan Nasional (PN) government of Muhyiddin Yassin has a slim majority of two or three MPs, and the recent move by the opposition leader Anwar Ibrahim to take over the government, it would be reasonable to suspect that the real purpose of advising the Agong to declare a national state of emergency is politics.

If the state of emergency involves the suspension of Parliament and civil liberties, then it would be tantamount to a self-coup by the Muhyiddin government in order to stay in power. A state of emergency allows for the Agong-appointed government to make ordinances that will have the same force and effect as an Act of Parliament, and it shall continue in full force and effect as if it is an Act of Parliament until it is revoked or annulled and they cannot be challenged in the courts. This also gives the federal government power to overrule state governments.

The last time a nation-wide state of emergency was announced was during the May 13th riot in 1969. Besides the ramifications on our countrys democratic checks and balances, there will also be serious consequences on the economy.

If the purpose of the emergency is to combat COVID-19, a targeted or enhanced MCO like what we had would be sufficient. Act 342, otherwise known as the Prevention and Control of Infectious Diseases Act 1988, has sufficient provisions for measures to curb the spread of COVID-19 including the power to make regulations, control the movement of people and move armed forces, as we have seen thus far.

BERSIH 2.0 would like to appeal to the politicians to put aside their differences and work together with a confidence and supply agreement. This would mean that the opposition would agree not to vote against PN government in votes of confidence or budgetary matters while reserving the right to oppose other legislations. This would ensure the COVID-19 relief budget scheduled to be tabled next month will go through and preserve stability in Parliament.

Pengisytiharan darurat hanya dilakukan bilamana terdapat unsur ancaman pada keselamatan negara.

Tetapi apabila kerajaan itu sendiri yang menjadi punca pada ancaman keselamatan, maka langkah darurat ternyata suatu langkah ke belakang yang akan memungkin kediktatoran.

Saya menggesa Tan Sri Muhyiddin Yassin untuk menimbang semula keputusan ini kerana ia ternyata suatu keputusan yang pendek akal dan penting diri,- Anwar Ibrahim.

Darurat dalam Perkara 150 Perlembagaan

Oleh kerana tidak semua orang mampu membaca Perkara 150 Perlembagaan (kalau baca pun belum tentu faham bahasa perlembagaan ini) maka saya ringkaskan untuk pemahaman awam. Perbahasan pasal darurat ini banyak khilaf ahli undang-undang dan ini adalah ekstrak daripada Perkara 150 Perlembagaan Persekutuan.

1. Yang di-Pertuan Agong (YDPA) sahaja yang boleh isytihar darurat.

2. Perisytiharan darurat boleh dibuat sebelum berlaku kejadian mengancam keselamatan, kehidupan ekonomi atau ketenteraman awam.

A. YDPA boleh isytihar pelbagai jenis darurat atas alasan berbeza-beza atau dalam hal keadaan yang berlainan.

B. Semasa dalam darurat, YDPA boleh luluskan undang-undang tanpa melalui proses Parlimen jika Parlimen tidak bersidang.

C. Undang-undang yang diluluskan YDPA itu sama kuasa macam akta Parlimen (namanya Ordinan).

3. Ordinan YDPA itu hendaklah nanti dibawa ke Parlimen setelah Parlimen bersidang dan hanya terhenti digunakan jika Parlimen meluluskan ketetapan untuk tidak memakai lagi Ordinan YDPA itu.

4. Selama mana darurat itu berlangsung, kuasa pentadbiran kerajaan Persekutuan akan meliputi kerajaan negeri termasuk untuk membuat undang-undang bagi kerajaan negeri atau mengarahkan pegawai-pegawai kerajaan negeri.

5. Semasa dalam darurat, Parlimen boleh luluskan apa-apa undang-undang tanpa berunding dengan kerajaan negeri (dalam hal yang sepatutnya dirundingkan mengikut Perlembagaan.

6. Apa-apa ordinan yang diluluskan YDPA atau akta Parlimen yang diluluskan dalam tempoh darurat adalah kebal daripada tindakan undang-undang walaupun tidak konsisten dengan Perlembagaan.

A. Namun, akta Parlimen itu tidak boleh dibuat berkaitan hal agama Islam, adat istiadat Melayu, adat istiadat bumiputera Sabah/Sarawak. Ordinan YDPA pula tidak boleh tidak selari dengan peruntukan berkaitan agama, warganegara dan bahasa.

7. Tempoh kuatkuasa Ordinan YDPA ini adalah sehingga 6 bulan selepas perisytiharan darurat itu tamat.

8. (a) Keputusan YDPA bahawa baginda puashati wujud ancaman keselamatan, kehidupan ekonomi atau ketenteraman awam itu tidak boleh dicabar di Mahkamah.

(b) Mahkamah tiada kuasa untuk melayan apa-apa permohonan yang dibuat yang mencabar keesahan perisytiharan darurat atau Ordinan YDPA.

9. Dewan Rakyat/Dewan Negara hendaklah dianggap bersidang hanya jika ahli parlimen/senator itu berhimpun dan menjalankan urusan Parlimen itu.

Nationwide emergency disproportionate and may invite constitutional crisis, Malaysian Bar warns

KUALA LUMPUR, Oct 23 The Malaysian Bar today urged Putrajaya to reconsider its purported proposal to seek emergency powers to handle the third wave of Covid-19, saying such a move would be disproportionate.

In a statement, it said that declaring an emergency may result in a constitutional crisis, adding that Malaysia already has sufficient measures in place to combat the pandemic, such as the Prevention and Control of Infectious Diseases Act 1988.

Declaring a nationwide emergency is disproportionate as there are already standard operating procedures in place.

The Malaysian Bar is concerned that an emergency would cause a plunge in confidence for individuals and businesses alike, its president Salim Bashir said.  

It added that the public now needs stability and focus on public health instead of emergency laws.  

Any move to declare an emergency will be perceived as a regressive approach on the rule of law and parliamentary democracy. The Malaysian Bar is also deeply troubled over the threat of a potential constitutional crisis should a state of emergency be declared, it said.

It also expressed its confidence that Putrajaya will be able to handle the current situation and find prudent solutions without resorting to declaring an emergency.

Earlier, Prime Minister Tan Sri Muhyiddin Yassin and several other government leaders attended an audience with Yang di-Pertuan Agong Sultan Abdullah Riayatuddin Al-Mustafa Billah Shah at the latters Istana Abdulaziz in Kuantan.

However, no announcement was made following the audience.

Speculation had been rife that the Perikatan Nasional government is seeking to declare a state of emergency as Malaysia struggles to contain the spike in Covid-19 infection that has also hurt the economy.

Reports have so far suggested that Putrajaya is seeking a dubious so-called state of partial emergency, also dubbed as economic, health, or political emergency.

It is unclear what the emergency powers being sought are at the moment as the breadth and scope under a state of emergency are far ranging.
