Wajib ke tak utk company membayar OT?

nak tau sgt... btw aku keje kat design industry.. n kitorang ni keje ala2 artist..tak tentu masa gitew

kekdahnye hampir 90% design company ni tamo bayar OT gaji da la ciput (excluding my comp) kengkadang kesian tgk kawan2 mengadu nasib keje byk gaji sket kene keje sampai lewat mlm tadek OT..

haihhh...

setau aku wajib...melainkan klu dh level eksekutif ke atas...
level tu kire tk pyh sbb basic dh tinggi.

alamak aku lupe nak kasi tau satu bende...

most of design company suke gunekan position eksekutif utk lari dr bayar OT cthnye eskeskutif teknikal padahal gaji ciput 1300 jek.. kesian aku tgk nasib kawan2 aku neh..

aku tak rasa position memainkan peranan dlm menetukan OT tapi basic salary...cam tempat aku keje...those yg dibayar dgn basic Pay below RM1.5K berhak diberi OT...regardless of position.

Cuma kalau tak silap aku...OT tak boleh melebihi 104 Jam sebulan melainkan dlm kes2 tertentu ( special case )

mungkin jac leh report atau tanya kepada jabatan Buruh...mungkin jawapan yg diterima akan lebih pasti....

Berkemungkinan yang sesetengah Company ni tak pernah hadapi atau berdepan dgn staff yg berani bertindak...tak pernah berlaku....so...apa2 sajer rules Company tu ...diterima bulat2 oleh staff tanpa memekirkan yg mereka sepatutnya boleh dapat lebih dr sepatutnya....

cam kampeni aku apa level pun bleh OT....tapi depa kasi flat rate weekdays depa kasik 14 hingget...sunday or public holiday depa kasik 18 hingget....

OT neh atas budi pekerti office memasing.. company berhak nak bagi ke tak..

tapi kita as employee pun ada hak jugak.. kalau tak silap setiap minggu, kita tak leh kerja more than 52 hours(correct me if i'm wrong), selebihnya kita berhak untuk claim samada meal allowance/OT.. unless kalau ko punya Job Description tu memerlukan ko kerja long hours seme tuh... mmg tak boleh buat apa la kan.. sebab way before ko sign offer letter seme tuh.. ko mmg dah patut tahu seme neh..

biasanya local bank mmg practice mcm nie.. executive mmg takleh claim OT, cuma leh claim meals allowance ajelah..

RM16 hinggit ok la tuh med.. ada payment/forex department kat office haku neh.. ada yg kena kerja sampai kul 1,2 pagi tapi management prepare nasi lemak ajer during maghrib tuh... sian aku tgk budak2 tuh..

yg bape hinggit tak tahu la kan.. siap ada lauk pauk seme.. kalau makan kat kedai ada la 5,6 hinggit kot..

everytime haku nak masuk keje malam kul 8, sokmo terserempak ngan budak2 payment neh tgh ambik nasi kat resource center kitaorang.. masing2 bawak satu pinggan bawa balik tempat masing2..

no wonder la that department punya staff turn over tinggi..

budak gaji tinggi sket dapat...tapi kasik 14 hingget tue kalo compare ngan basic memang rasa x best laaaa....coz sket bagi depa....

kat kampeni seblom ni... sampai level asst. manager bule claim OT...
kalo keje satu hari ahad.. bule gak le cecah RM400~500... hidup dgn duit OT aje

semuanya bergantung pada agreement yg kita sign... seblom sign baca dulu wehhhh... bila dah sign maknanya kita setuju dgn apa jua syarat yg kampeni buat as long kampeni tu tak langgar mana2 akta buruh, mana leh kita nak samannn..
cuma buat la aduan dan rayuan pada pihak pengurusan... tapi dizaman kegawatan ni agak mencabar gak le kalo nak mintak lebeyyy...

mcm my big bos dulu.. kalo komplen kata gaji rendah... dan compare kampeni sebelah bagi lagi tinggi.. mat jepun ni jawap... "you don't work here.. you work there.."
