KOTA KINABALU: Bekas Ketua Unit Anti Maksiat, Perjudian dan Gangsterisme (D7) Ibu Pejabat Polis (IPK) Sabah menghadapi hukuman penjara berjumlah 100 tahun dengan 15 sebatan kerana merogol dan meliwat seorang gadis berusia 13 tahun.

Deputi Supritendan Rohaizat Abd Ani, 56, bapa kepada dua anak, didapati bersalah atas empat pertuduhan rogol dan satu liwat antara Februari dan Mei 2012.

Hakim Mahkamah Sesyen, Ainul Shahrin Mohamad memerintahkan hukuman maksimum 20 tahun penjara bagi setiap pertuduhan.

Rohaizat didapati bersalah atas tuduhan merogol dan meliwat mangsa antara pukul 4.30 petang dan 5.30 petang di sebuah bilik di Hotel Tang Dynasty di sini pada 1 Februari 2012.

Pada keesokan harinya, dia kemudian merogol semula gadis tersebut antara pukul 12.30 tengah hari dan 1.30 petang di bilik lain hotel yang sama.

Former Sabah anti-vice chief Deputy Superintendent Rohaizat Abd Ani was sentenced to 100 years in prison as well as 15 strokes of the rotan for raping and sodomising a 13-year-old girl.

The 56-year-old was found guilty of four charges of rape and one count of sodomy between February and May 2012 as reported by The Star Online.

He received the maximum jail sentence of 20 years for each charge by sessions judge Ainul Shahrin Mohamad.

Rohaizat was found guilty of rape and sodomy committed on the victim in a room at Tang Dynasty Hotel, Kuala Lumpur, on Feb 1, 2012 between 4.30pm and 5.30pm and on Feb 2, between 12.30pm and 1.30pm in another room of the same hotel.

Rohaizat was also found guilty of raping the victim between May 1 and 6, also at the Tang Dynasty Hotel.

The accused was sentenced to 20 years each for the first two charges which are to run concurrently, and 20 years’ jail, to run consecutively for each of the three remaining charges.

Judge Ainul Shahrin agreed with the opinion given by Deputy Public Prosecutor Azeezi Nordin that the seasoned police official was entrusted with protecting the public but had betrayed that trust.

“The victim was 13 at the time of the incident. She was raped and sodomised by a 52-year-old, clearly a total manipulation of a child by an adult.

“The repetitious act of the accused in three months starting from February showed that the accused never considered the victim’s age, emotions and consequences of his action,” Azeezi was quoted as saying.

Rohaizat’s lawyer, Zahir Shah, will appeal against the sentence.

The judge granted a stay of execution of the sentences pending appeal in the High Court.

Bail was set at RM100,000 with one local surety and the accused was told to surrender his passport and report to the police in Bukit Aman on the 1st and 15th of each month.

Rohaizat, who is currently suspended from his duties, had served as Setiu police chief briefly and was serving as deputy chief of the Federal Reserve Unit in Penang when he was charged in Aug 2013.-TRP

KOTA KINABALU: A prosecution witness in the trial of a Deputy Superintendent of Police charged with four counts of raping an underage local girl and sodomising her told the Sessions Court that the girl claimed she was raped and that a woman made her a 'prostitute'.

A guidance and counseling teacher of a school here testified before Judge Ainul Shahrin Mohamad on Monday that the girl told him during a counseling session in the school at 2.30pm on Sept 6, 2012 that she was raped or had been made a prostitute by an 'aunt'.
The teacher, who was the prosecution's second witness in the trial of DSP Rohaizat Abdul Ani, said the alleged victim had been referred to him by a senior assistant (student affairs) at 7.30am on Sept 6, 2012 for a counseling session as she had run away from home.    He said he let the alleged victim tell what she had experienced and that the girl at first told him the reason she ran away from home was because she could not bear her mother calling her 'anak sial' and a prostitute.

  The alleged victim then related to him that she was raped by someone or made a prostitute by a woman to pay the rental of a house and as a source of income to help her family and that the first incident occurred between February and March the same year and prostituted on five occasions. The teacher said the alleged victim claimed there were three men who raped her – a police officer, a doctor and a 'orang putih' at Tang Dynasty hotel and another hotel, the name of which he could not recall. The alleged victim also said that the police officer had raped her during the first, second and third incident and claimed the said police officer also had sodomised her.  "The alleged victim did not mention the police officer's name but she knew the said officer's job as she overheard his conversation with the 'aunt'," said the teacher, adding that the girl also told him the said officer did ask her whether she had any friends, who are still virgin who could have sex with him.

To a question by Senior Federal Counsel Jamil Aripin during examination-in-chief, on whether or not the alleged victim agreed to being made a prostitute on the first instance, the teacher replied that the girl did not know she had been made a prostitute then.

He testified that he did not ask the alleged victim whether she agreed to being a prostitute the rest of the time and that the girl did not tell him how much was paid every time.

The teacher said the counseling session took about 40 minutes to an hour and that at the end of the session, the alleged victim wished to make a police report to protect her younger siblings from experiencing similar things as her.

According to him, based on his experience, the alleged victim spoke the truth throughout the session and was very earnest and emotional when recalling the incidents. "I had to on several occasions, give her time to compose herself to relate further. She did cry during the session and I gave her time to calm down," said the teacher, adding she gave him permission to reveal the information in the counseling session at the end of the session when she told him her intention to lodge a police report.

The teacher said he then related the matter to the senior assistant (student affairs) and the principal, who then instructed him to bring the alleged victim to lodge a police report at about 8pm on the same day.

He said he also made a police report at about 1am or 1.30am based on what the alleged victim told him after the girl made a police report herself. During cross-examination by one of Rohaizat's counsel Zahir Shah, the teacher said the alleged victim has been housed at the school's hostel after she ran away from her house.

Asked whether the alleged victim was still a virgin during the first alleged rape incident, the teacher replied the girl did not tell him about it.

To a question, the teacher said based on his observation during the counseling session, the alleged victim appeared to be an adult.  Rohaizat, 55, who is accused of raping the 13-year-old girl on four separate occasions at 3.30pm on Feb 1, 2012 in a room at Tang Dynasty Hotel, at 10am on Feb 2, 2012 in another room of the same hotel, between 7pm and 8pm, between  May 1, 2012 and May 6 the same year in a room of the same hotel and at 3am between May 1, 2012 and May 6 the same year in a room of the same hotel.

Each charge under Section 376 (1) of the Penal Code carries a jail term of up to 20 years and liable to whipping on conviction.

Rohaizat is also accused of sodomising the girl at 3.30pm on Feb 1, 2012, in a room of the same hotel, an offence under Section 377B of the Penal Code which provides for an imprisonment of up to 20 years and liable to whipping on conviction.

Meanwhile, the prosecution's first witness Lance Corporal Khadijah Mohd Seruji, an information recorder attached to the Karamunsing police station, confirmed to have recorded a report lodged by the alleged victim at 9pm on Sept 6, 2012.

Khadijah said the alleged victim entered the premises accompanied by a teacher and a friend who then sat at the visitors' seat while the girl came to the counter and told her story which she then recorded. SFC Jamil prosecuted together with Deputy Public Prosecutor Effizah Ernie Idris while Zahir represented Rohaizat together with counsel Ram Singh.

Counsel Mary Lee is holding a watching brief for the Sabah Women Action Group while counsel Mary Gomez is holding a watching brief for Voice of the Children and Sabah Law Association.

Kota Kinabalu: Seorang pegawai kanan poilis yang bertugas dengan memberi tanggung jawab dan amanah untuk membenteras maksiat telah didakwa dengan empat tuduhan merogol seorang gadis berumur 13 tahun.

Deputi Supritenden Rohaizat Abd Ani, 54, bekas Ketua Cawangan D7 di Ibu Pejabat Polis Kontinjen Sabah yang juga pernah berkhidmat sebagai Ketua Polis Daerah Setiu pada awal tahun lepas, telah dituduh merogol gadis itu di sebuah bilik hotel di sini pada kira-kira 15:30 pada 1 Feb tahun lepas.Beliau juga didakwa meliwat gadis itu pada hari dan tempat yang sama dan juga dituduh merogol gadis itu sekali lagi pada kira-kira 10:00 pada hari berikutnya.Apabila pertuduhan keempat merogol gadis itu di hotel yang sama pada bulan Mei tahun lepas telah dibacakan, dia bertanya: "Apa, tiada tarikh?"Beliau kemudiannya menggeleng-gelengkan kepalanya dan berkata: "

Tidak bersalah"Beliau mengambil nota apabila setiap pertuduhan dibacakan dan menjawab "Tidak bersalah" setiap kali dengan suara yang kuat dan jelas.DSP Rohaizat, yang kini bertugas sebagai Timbalan Ketua Unit Simpanan Persekutuan (FRU) di Pulau Pinang, tiba di mahkamah memakai jaket dan seluar gelap, ditemani oleh isterinya.

Bapa kepada dua anak itu menyembunyikan mukanya dengan akhbar apabila dia melihat wartawan dan jurugambar ketika berjalan ke dalam mahkamah.Timbalan Pendakwa Raya Jamil Aripin meminta ikat jamin sebanyak RM20, 000 bagi setiap tuduhan, mengatakan bahawa pertuduhan dikemukakan adalah sangat serius.Peguam DSP Rohaizat itu Ram Singh, bagaimanapun, memberitahu mahkamah bahawa anak guamnya memegang jawatan paling kanan dalam pasukan polis dan dia tidak akan melarikan diri.Ram berkata DSP Rohaizat bersedia untuk melaporkan diri ke Ibu Pejabat Polis Pulau Pinang dua kali seminggu jika perlu.Beliau juga menggesa bahawa jaminan sekurang-kurangnya RM5, 000 ditetapkan bagi setiap tuduhan.

Hakim Mahkamah Sesyen, Ismail Berahim, bagaimanapun, menetapkan jumlah jaminan pada RM40, 000 dan menetapkan 9hb Disember hingga 13 Disember sebagai tarikh perbicaraan. Jamil berkata, pihak pendakwaan mempunyai senarai 25 saksi tetapi tidak menentukan berapa ramai yang akan dipanggil untuk memberi keterangan.
