2 keluarga Spura eksiden kat South Afrika.....
Exotic holiday splits family friends after 30 years
SIA engineer dies when van driven by close friend crashes in South Africa
By Tay Shi'an
THEY were friends for almost 30 years.
Both were aircraft maintenance engineers at SIA Engineering.
Each had three children.
And they went on holidays together with their families.
But on their last trip, in South Africa, tragedy struck. The van they were travelling in crashed and one of them died.
It would destroy the friendship the families had shared for so many years.
The families of Mr Lim Him Long and Mr Foo Wah Jek used to visit each other on occasions like Chinese New Year.
In December 2001, the two families went on an exotic 10-day holiday to South Africa.
They rented a passenger van, which came with a South African tour guide-cum-driver.
While travelling between two towns about 200km from Capetown, their guide, who was Muslim, told the families that he was tired and needed a break as he was fasting.
Mr Foo then took over the wheel. He was driving when the right rear tyre on their van burst.
The vehicle veered off the road, rolling over. Mr Lim, 46, was thrown out of the van and died instantly.
Three years on, neither family has been able to put the past behind them.
RELIVING TRAGEDY IN COURT
Mr Lim's widow, Madam Loh Luan Choo, 45, sued Mr Foo, 49, for negligence and causing her husband's death, and for the injuries her second son suffered - a dislocated hip and fractured collarbone.
Both families have been reliving the tragedy in the High Court over the past two years and are no longer on speaking terms.
Last month, the Court ruled that Mr Foo was not negligent and dismissed the case. (See report on facing page.)
Madam Loh has since filed an appeal.
And for Mr Foo, it was nothing but a hollow victory.
He was clearly upset and emotional during a short phone interview yesterday.
He said: 'We are not very happy in winning the case also... We were friends, but because of the accident, we ended up in such a case... I knew (Mr Lim) for almost 30 years, and now his family is after my blood.'
Mr Foo said the accident affected not just Madam Loh's family, but his as well.
He has two sons, aged 15 and 18, and a daughter, 19.
He said he was tired of the matter and wanted to put it behind him.
He said: 'I have gone through two, three years of this. We've gone through enough pain... Now that a judgement has been made, I just want to carry on.'
The New Paper also visited Madam Loh at her home yesterday.
Tears welled up in her eyes when she talked about her family's loss, and how the accident affected her three sons, now aged 22, 19 and 15.
CHILDREN STILL TRAUMATISED
She said her children were traumatised by the accident, and their grades had dropped.
So, she tried to shield them by not discussing details of the court case.
Her oldest and youngest sons still do not know that the case has been dismissed, and is currently under appeal.
Only her second son, who had to testify in court, knows.
Madam Loh requested that we not publish pictures or too many details about her family, as she did not want her children to be further affected.
But the scars remain.
'We were traumatised by flying for a while. The whole family has not travelled together since the accident,' she said.
She could not show us pictures of the South Africa trip as the digital photos had accidentally been deleted.
She also could not find the prints, and thinks she may have thrown them away.
Madam Loh still keeps a family picture in her wallet, taken five years ago when they were holidaying in Sydney.
There were also several pictures of Mr Lim and the family displayed in the living room.
Madam Loh said: 'I'm sad and disappointed with the outcome. I want to move forward, but I don't have closure.'
--------------------------------------------------------------------------------
Judge: He did what he thought was the right thing
JUSTICE Judith Prakash found that Mr Foo Wah Jek had not been negligent.
'He was frightened for the safety of his family and friends and did what he thought was the right thing, on the basis of his previous experience, to keep them safe,' said Justice Prakash.
The case centred around whether Mr Foo had acted reasonably to keep the van in control after the tyre burst.
In her suit, Madam Loh Luan Choo noted that Mr Foo had applied the brakes twice - once lightly and then much harder. It was the hard braking that had caused the van to veer and crash.
But Mr Foo was caught in a sudden, dangerous situation and had only seconds to react, the High Court found.
Justice Prakash also noted Mr Foo was still guilt-ridden. She said:
'Having seen him in the witness box, I know that the defendant will be haunted for a long time to come, if not for the rest of his life.
'No matter how much (he) may privately castigate himself for his actions on that day, such regrets do not make him responsible... for the sad outcome of something that was done with the best of intentions for all concerned and with the exercise of ordinary care and skill.'
Madam Loh's case was that it was not reasonable for Mr Foo to brake hard as the car was travelling along a straight road with no other vehicles in sight.
Her lawyers submitted that in all probability, the vehicle would have travelled in a straight path if the brakes had not been applied the second time.
The prudent course, they argued, would be for the driver to hold the steering wheel tight, release the accelerator and allow the vehicle to slow down and stop, or wait till the vehicle had slowed down before applying the brakes again, gently.
Mr Foo's defence was that he did not cause the car to go off the road with his driving and braking.
Defence witness Johannes Jacobus Heese, a senior mechanical engineering lecturer from South Africa's University of Stellenbosch, noted that the reaction of the vehicle to the application of the brakes after the tyre burst 'was not normal'.
Mr Heese believed that the two front brakes were probably not equally effective. If one was more effective than the other, the car would swing to one side, thus causing the accident.
The judge noted that Mr Foo had once encountered a similar incident while driving in Malaysia and he had braked to stop his car, without any problem.
Although the same method was not suitable for the van that he was driving, 'he... was not afforded the luxury of the time needed to logically process the consequences of the first braking action'.
Mr Foo also could not be faulted for his driving. Before the crash, the judge noted, Madam Loh had not raised any complaint about his driving.
'In fact, she felt safe during the journey,' the judge said. |

kita still kena pegi as a tour la eh? tu la problem dia....
tapi kalo berani , pegi sendiri.......then boleh jalan2 at our own pace, dan kita boleh pilih tempat2 yang kita suka aje....
ada positif dan negatif la ye... |
