Vandalisme : Dua remaja Jerman mungkin disebat di Singapura

SINGAPURA, 10 Februari  :

Dua orang pemuda jerman mengaku bersalah di  atas kesalahan vandalisme, kesalahan yang boleh dihukum dengan hukuman sebat  setelah kedua-duanya didakwa menyembur cat di kereta api Metro di Singapura,  lapor peguam mereka pada Isnin.

Peguam Christopher Bridges berkata, anak guamnya  Andreas Von Knorre dan Elton Hinz, kedua-duanya 21 tahun, juga akan mengaku  bersalah terhadap dua pertuduhan menceroboh ketika pendengaran kes pada 5  Mac.

Mereka dilaporkan akan dihukum pada hari yang  sama.


Vandalisme membawa hukuman sehingga tiga tahun  penjara atau denda sehingga Sg$2,000, dan antara tiga sehingga lapan sebatan – hukuman sejak penjajahan British di republik ini.

Bridges memaklumkan kepada pemberita selepas  pendengaran tertutup sebelum perbicaraan dengan pendakwa dan hakim, jumlah  pertuduhan terhadap anak guamnya telah dikurangkan daripada empat kepada  tiga.

“Mereka akan mengaku bersalah dan menghadapi  hukuman bulan depan bagi ketiga-tiga pertuduhan,” kata Bridges.


“Saya tidak boleh mengesahkan … kemungkinan  hukuman sebat. Itu terpulang kepada budi bicara hakim.”

Di bawah undang-undang pesalah vandalisme kali  pertama, mereka boleh terlepas hukuman sebat jika ‘tulisan, lukisan, tanda  atau ukiran’ boleh dipadamkan, tetapi pengecualian tersebut tidak terpakai jika  kesalahan tersebut menggunakan bahan kekal seperti cat atau tar.

Untuk menceroboh, dua rakyat Jerman  terbabit akan menghadapi sehingga dua tahun penjara, denda sehingga  Sg$1,000, atau kedua-duanya sekali bagi setiap pertuduhan.

Kedua-dua mereka dituduh menceroboh ke depot dan  menyembur lukisan grafiti di luar kabin kereta api Metro di pinggir bandar  November lalu. Depot adalah zon larangan untuk orang awam yang dikelilingi oleh  pagar kawat berduri.

Mereka telah diekstradisi ke Singapura oleh  pihak berkuasa negara Malaysia selepas ditangkap di Lapangan Terbang  Antarabangsa Kuala Lumpur kerana mereka telah bercadang untuk ke Australia.

Kedua-duanya telah direman di Penjara  Changi.

Singapura, hab kewangan Asia terkemuka, terkenal  kerana pendirian tegas ke atas jenayah.

Undang-undang vandalisme negara ini telah  menjadi berita global pada tahun 1994, apabila seorang remaja Amerika, Michael  Fay, telah disebat kerana merosakkan kereta dan merosakkan harta benda awam.

Pada tahun 2010, seorang warga Switzerland,  Swiss Oliver Fricker dijatuhi hukuman tujuh bulan penjara dan tiga sebatan  selepas dituduh merosakkan kereta dan menyembur cat pada kereta api di  depot.

Two young German men will plead guilty to vandalism, an offense punishable by caning, after spray-painting a metro train in Singapore, their lawyer said Monday.'

Lawyer Christopher Bridges said his clients Andreas Von Knorre and Elton Hinz, both 21, would also enter a guilty plea to two counts of trespassing at a hearing on March 5. They will be sentenced the same day.

Vandalism carries a penalty of up to three years in jail or a fine of up to Sg$2,000 (US$1,478), and between three and eight strokes of a rattan cane -- a punishment dating back to British colonial rule in the city-state.

Bridges told reporters after a closed-door pre-trial hearing with prosecutors and the judge that the number of charges against his clients had been reduced from four to three.

"They will plead guilty and face sentencing next month to the three charges," Bridges said.

"I cannot confirm ... the likelihood of caning. That is up to the discretion of the judge."

Under the law first-time offenders can be spared caning for vandalism if the "writing, drawing, mark or inscription" can be erased, but not when indelible substances such as paint or tar are used.

For trespassing, the Germans face up to two years in jail, a fine of up to Sg$1,000, or both for each count.

The two were accused of breaking into a suburban depot and spray-painting graffiti on the exterior of a metro train cabin last November. The depot is a restricted zone surrounded by fences topped with barbed wire.

They were extradited to Singapore by neighboring Malaysia after being arrested at Kuala Lumpur International Airport as they were leaving for Australia.
Both remain in remand at Changi Prison.

Singapore, a leading Asian financial hub, is known for its tough stance on crime.

Its vandalism laws became global news in 1994 when an American teenager, Michael Fay, was caned for damaging cars and public property.

In 2010 Swiss expatriate Oliver Fricker was sentenced to seven months in jail and three strokes of the cane after he used spray paint to vandalize a train at a depot.

Caning entails being whipped on the back of the thigh below the buttocks, which can split the skin and leave lasting scars.
