Transfer of Strata Title

Salam semua !

Saya baru kat Bod ni.  dah check kat page blkg2, rasanya belum ada thread pasal Transfer of Strata Title ni...

Saya cuma nak tanya, macamana proses Transfer of Strata Title and brp kos dan brp byk lawyer yang terlibat.

Saya divide and conquer soalan u yer....

Berapa lawyer terlibat?

Same as transfer for non-strata title property.

Kos terlibat?

Depends on property...lebih mahal property, lebih mahal lawyer fees..

Proses transfer?

Hampir sama dengan transfer non-strata title cuma guna form berlainan.

Untuk maklumat lanjut saya kena bukak balik buku2 lama aku...huhuhu

sebenarnya masalah saya mcm ni :
apartment yg saya beli dlm tahun 2000 telah pun dikeluarkan strata title.  somewhere around end of 2003 saya dpt surat dari developer utk execute the transfer.  saya dah pun pegi jumpa lawyer yg uruskan the transfer around early 2004 dan dah bayar pun fees and disbursement.  lawyer tu kata, nnt saya akan dihubungi oleh lawyer bank pula utk sign more documents and to pay more fees.

tapi smpi skrg saya tak pernah terima apa2 communication dari mana2 lawyer ataupun developer sendiri.  saya ingat dah clear la transfer tu....  tiba2 last week saya dpt surat reminder dari developer utk execute the transfer, failing which dia kata saya dah breach the S&P agreement.  at the same time dia suruh saya pegi jumpa lawyer yg keluarkan S&P.

saya tak faham sebenarnya mcmn proses nak transfer strata title ni.  dah byk kali call developer nak dptkan clear picture apa tanggungjawab saya, tapi PIC dia asyik takde, mtg la keluar la .....  mcm sengaja nak mengelak saya.  mintak dia return call pun jgn harap dia nak call.....  tu yg saya sgt musykil.

normally, lawyer yg handle transfer of the strata title mmg berbeza ke dari lawyer yg keluarkan S&P (in my case dua2 lawyer dilantik developer).

harap sgt rurouni atau sesapa yg tahu exactly proses transfer of strata title ni lighten me up a bit....  plus nak jugak tahu roughly brp byk lagi kos yg saya kena sediakan to complete the transfer.

You dulu buat loan dengan bank ape?

I assumed your payments dah selesai kan sebab tu u bole transfer title tuh. (correct me if i'm wrong plz)

Ye, biasenya dalam hal nie memang lebih dari satu lawyer terlibat. Developer ade lawyer, bank pun ade. so you kena deal dengan both parties.

Camni, you call balik bank yang u buat loan tuh dan tanye die punye panel lawyer yang handle diorag punye charge atas property u. Bile dah tau sape lawyer tuh u forwardkan surat kebenaran untuk execute transfer tuh pada lawyer tuh.

I rase lebih elok u follow up sendiri dari tunggu telefon dari lawyer tuh.

Tapi nie pendapat saya, maybe ade sape2 lagi nak bagi pendapat?

khairul, dia buat transfer not necessarily bcoz dah habis bayar.. transfer kena buat selalunya sebab dah dpt title.. bila title dah keluar, u kena buat transfer from the Developer into your name and register the Bank's charge at the same time..

If I am not mistaken, selalunya lawyer bank yg akan pegi register transfer & charge kat land office coz dia mesti nak jaga interest bank-client dia.. lawyer kena prepare Form 14A (pindahmilik) and Form 16A (gadaian)..

yg byk as188 kena bayar nanti is stamp duty on the transfer.. ikut harga rumah tu.. lagi mahal lagi la byk stamp duty kena bayar..

as188, bole jadi jugak cam Airis cakap tuh...maybe title untuk pecahan lot tuh dah kuar dari pejabat tanah..

Dah dekat 3 tahun tak bukak buku pasal convey nie...

setahu saya, peguam yang mewakili bank perlu initiate segala tindakan/documentation.  pihak developer memang tak akan buat apa-apa.  

adakah stamp duty masih hanya 0.05% dari value yang ditetapkan?

stamp duty bila dah wat valueation rase nya 100k above 1% & 400k above lak 2%

lebih dari 500k 3%

Thanks pada semua yg respond.

Ok, saya dah clear skrg ttg proses transfer ni.  Sebenarnya, pada mulanya yg saya musykil tu, kenapa developer suruh saya pegi jumpa lawyer lain lagi utk execute the transfer sedangkan saya dah pun execute & sign dgn lawyer yg mereka mula2 appoint (note : this two lawyers bukan lawyer bank).

smlm saya pegi sendiri ke ofis developer and jumpa dgn property manager utk clearkan masalah.  rupanya, mereka kata sambutan dari owner2 lain utk execute the transfer tak brp bagus.  so, they appoint another firm to handle the transfer.  kata mereka, firm yg mula2 tu slow.  tu yg mereka hantar reminder utk saya execute balik dgn lawyer firm yg baru sbb lawyer yg saya dah sign tu tak fwd balik the docs to developer for further action.  so they assume saya ni salah satu owner yg belum execute....  gitu lah ceritanya lebih kurang...  patut pun, saya dah sign dlm 2004 lagi, tapi lps 3 tahun masih takde progress....  tido ke apa lawyer tu ?

so skrg, saya kena tunggu developer fwd the docs pada bank for further process by the bank's lawyers...
