Aku baru lepas tengok cerita ni semalam. Jalan cerita dia simple aje. Tapi penuh dengan nilai kemanusiaan la..
Kisah dia simple aje. Seorang pensyarah kejuruteraan kat kolej berjaya menemui kaedah untuk mencipta intermitten wiper (wiper macam yang ada kat kereta kita la) dengan mengambil ilham dari pattern kelipan mata manusia... Malangnya, idea dia ni dah dicuri oleh syarikat Ford. Dia terpaksa mengambil keputusan untuk menyaman syarikat Ford. Perjuangan dia ni berhadapan dengan banyak masalah. Sampai ke satu tahap, dia masuk hospital mental, bini dia tinggalkan dia, anak-anak lari dari dia, dia kena buang kerja dan syarikat guaman dia tak nak ambil kes dia...
Syarikat Ford pun buat berbagai cara untuk memastikan kes ni selesai di luar mahkamah. Sampai ke satu saat, depa sanggup offer 30 juta agar kes tu digugurkan. Apa jadi lepas tu? Lu tengok la sendiri yek..
Tapi ada beberapa benda berguna yang aku pelajari dari kisah ni...
1) Adakah di saat-saat sukar, orang yang kita sayangi akan sentiasa di sisi kita untuk menemani dan memberi semangat?
2) Adakah dalam kehidupan, karier dan perhubungan kita hari ini, kita mementingkan etika?
3) Kebijaksanaan ada di mana-mana saja. Yang penting untuk kita adalah bagaimana untuk menerbitkan 'spark' tu.. |

Based on the true story of college professor and part-time inventor Robert Kearns' long battle with the U.S. automobile industry, Flash of Genius tells the tale of one man whose fight to receive recognition for his ingenuity would come at a heavy price. The Kearns were a typical 1960s Detroit family, trying to live their version of the American Dream. Local university professor Bob married teacher Phyllis and, by their mid-thirties, had six kids who brought them a hectic but satisfying Midwestern existence. When Bob invents a device that would eventually be used by every car in the world, the Kearns think they have struck gold. But their aspirations are dashed after the auto giants who embraced Bob's creation unceremoniously shunned the man who invented it. Ignored, threatened and then buried in years of litigation, Bob is haunted by what was done to his family and their future. He becomes a man obsessed with justice and the conviction that his life's work-or for that matter, anyone's work-be acknowledged by those who stood to benefit. He sued Ford Motor Company in 1978 and Chrysler Corporation in 1982 for patent infringement. The Ford case went to trial in 1990 and there were two trials. Ford lost, although the court said Ford's infringement was not deliberate, and Ford agreed to settle with Kearns for 10.1 million with an agreement of no further appeals.
After the settlement with Ford, Kearns mostly acted as his own attorney in the subsequent suit against Chrysler, even questioning witnesses on the stand. The Chrysler verdict was decided in 1992, and was a victory for Kearns. Chrysler was ordered to pay Kearns 18.7 million with interest. Chrysler appealed the court decision, but the Federal Circuit let the judgment stand. The Supreme Court declined to hear the case. By 1995, after spending over 10 million in legal fees, Kearns received approximately 30 million in compensation for Chrysler's "non-deliberate" patent infringement.It is interesting to note that Chrysler was represented by Harness Dickey and Pierce, one of the first firms Kearns went to when he contemplated suing Ford in the late 1970's. Indeed, according to his son Dennis Kearns, Kearns wanted Harness Dickey removed for conflict of interest, but was unable to convince his attorneys to make a motion to remove Harness Dickey. He then decided to manage the Chrysler litigation on his own with his family. However, this strategy did not seem to work out well in subsequent litigation against GM and Mercedes as these firms were able to make the litigation so difficult that Kearns' claims were basically dismissed in the district court. |
